General Terms and Conditions

These General Terms and Conditions ("Terms") govern all services provided by the Environmental Project Management Office ("Environmental PMO"). By engaging our services, using our digital platforms, or participating in any collaborative activities with our team, the client acknowledges and agrees to be legally bound by the provisions outlined below.

Scope of Services

The Environmental PMO offers specialized project management and consulting services within the environmental sector, with a primary focus on water, waste, energy, and sustainability. Our activities include, but are not limited to, strategic planning, project coordination, environmental permitting support, stakeholder engagement processes, regulatory compliance advisory, risk assessments, and the provision of secure platforms for project collaboration and data sharing. The specific nature, scope, and duration of services will be defined in individual service contracts or Statements of Work (SoW) agreed upon with the client.

Client Responsibilities

To ensure effective collaboration, clients must provide accurate and timely information necessary for project execution. They are expected to participate actively in decision-making processes, respond to project inquiries, and cooperate with designated project managers. Clients are also responsible for safeguarding access credentials to platforms such as OpenProject and Tresorit and ensuring that these tools are only used by authorized personnel. Misuse or unauthorized sharing of access credentials may result in suspension of services or termination of the agreement.

Confidentiality

The Environmental PMO treats all information shared by the client as strictly confidential. This includes technical documents, project communications, internal reports, and any data exchanged during the course of our engagement. We undertake not to disclose any such information to third parties without the client's prior written consent, unless required by law or by competent authorities. All personnel, contractors, and collaborators engaged by the Environmental PMO are bound by confidentiality agreements to ensure that sensitive information remains protected throughout and beyond the duration of the project.

Data Protection and Security

The protection of client data is a fundamental priority for the Environmental PMO. We operate in full compliance with applicable data protection regulations, including but not limited to the General Data Protection Regulation (GDPR), and relevant national laws. All information processed through our platforms is encrypted and hosted on secure infrastructure. Our service providers, including OpenProject and Tresorit, adhere to the highest international standards in information security. We apply role-based access controls, implement secure data retention policies, and conduct regular monitoring to prevent unauthorized access, alteration, or disclosure of data. Clients retain full ownership of their information and may request access, correction, or deletion of their data at any time through formal written communication.

Intellectual Property

Unless otherwise stipulated in writing, all reports, methodologies, systems, databases, and tools developed by the Environmental PMO during the provision of services remain our exclusive intellectual property. Clients are granted a limited, non-exclusive, and non-transferable right to use these deliverables for internal, project-related purposes. Any reproduction, redistribution, or commercial exploitation of our intellectual property without prior written authorization is strictly prohibited.

Fees and Payment Terms

The fees for services provided by the Environmental PMO will be detailed in the relevant service agreement or proposal. All invoices must be settled within the payment terms specified in the contract, which typically range from fifteen to thirty calendar days. Failure to meet payment deadlines may result in delayed delivery, restricted access to project tools, or suspension of services. In the event of non-payment beyond the stipulated period, the Environmental PMO reserves the right to initiate legal or collection procedures.

Limitation of Liability

While we make every effort to provide accurate, reliable, and professional services, the Environmental PMO shall not be liable for any indirect, incidental, special, or consequential damages that may arise from the use of our services or deliverables. Our total liability, under any circumstances, shall be limited to the total amount paid by the client for the specific service from which the claim arises. The Environmental PMO does not accept responsibility for decisions made by the client or third parties based on our advice, documentation, or software tools.

Termination of Services

Either party may terminate the service agreement at any time by providing written notice within the timeframe specified in the contract, typically with a minimum of fifteen calendar days. Upon termination, both parties shall fulfill all outstanding obligations, including payment for services rendered up to the termination date. Any deliverables completed or in progress at the time of termination will be handed over as agreed, provided that payment obligations are met.

Revisions to Terms

The Environmental PMO reserves the right to revise these Terms periodically. Any substantial changes will be communicated to active clients. Continued use of our services after the effective date of such updates will be considered as acceptance of the revised Terms. Clients are encouraged to consult this page regularly to remain informed of any modifications.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of the jurisdiction in which the Environmental PMO is legally registered. Any dispute arising from these Terms or the services rendered shall be resolved before the competent courts located in the city or region agreed upon in the service contract, unless both parties agree to mediation or alternative dispute resolution procedures.
